These Terms and Conditions ("Terms") govern your use of the Need of Change Foundation website (needofchange.org) and all services offered therein, including making donations, accessing the Donor Portal, subscribing to newsletters, and submitting enquiries.

By accessing our website or making a donation, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use of our website.

Need of Change Foundation is a registered non-governmental organisation operating in India with the following registrations:

• Registered under the Societies Act
• 12A Certified (Income Tax Act, 1961)
• 80G Certified (Income Tax Act, 1961)
• Registered on NGO Darpan Portal
• CSR-1 Registered on MCA Portal
• Registered on e-Anudaan Portal

• You must be at least 18 years of age
• You must have the legal authority to use the payment method provided
• Indian nationals and NRIs may donate through our domestic payment gateway
• Foreign nationals wishing to donate must contact us directly as FCRA regulations govern foreign contributions

a) Voluntary Nature

All donations are completely voluntary. By making a donation, you confirm that:

• The payment is made of your own free will
• You are the authorised holder of the payment method used
• The funds are from legitimate sources

b) Use of Funds

Donations received by Need of Change Foundation are used exclusively for:

• Direct programme delivery (education, healthcare, elderly care, women empowerment)
• Programme management and field operations
• Organisational administration (capped at 12% of total funds per our financial allocation policy)

We reserve the right to allocate funds across our programmes based on the most urgent community needs at any given time, unless a donation is specifically designated for a named programme by the donor in writing at the time of donation.

c) No Goods or Services in Exchange

Donations do not entitle the donor to any goods, services, equity, or control over the organisation. Donation acknowledgements and 80G certificates are issued as a matter of legal compliance, not as consideration.

d) 80G Tax Exemption

• Need of Change Foundation is 80G certified under the Income Tax Act, 1961
• Donors who provide a valid PAN number will receive an 80G certificate within 30 days of donation
• The 80G deduction allows donors to claim 50% of the donated amount as deduction from taxable income
• We are not responsible for changes in tax laws that may affect the quantum of tax benefit available to donors

a) Account Creation

You may create a Donor Portal account to manage your donations, download receipts, and access 80G certificates.

b) Account Security

• You are responsible for maintaining the confidentiality of your login credentials
• You must notify us immediately of any unauthorised use of your account
• We will not be liable for losses arising from unauthorised account access due to your failure to secure credentials

c) Account Termination

We reserve the right to suspend or terminate Donor Portal accounts in cases of:

• Fraudulent activity
• Attempted misuse of the platform
• Provision of false information
• Violation of these Terms

a) Permitted Use

You may use our website for lawful purposes only, including:

• Making donations
• Accessing programme and impact information
• Submitting enquiries and partnership requests
• Downloading published reports and certificates

b) Prohibited Use

You must not:

• Attempt to gain unauthorised access to any part of our website or systems
• Use the website to transmit harmful, offensive, or fraudulent content
• Scrape, copy, or reproduce our website content without written permission
• Impersonate our organisation or staff
• Use automated bots to interact with our donation forms

c) Intellectual Property

All content on this website — including text, images, logos, programme names, and design — is the intellectual property of Need of Change Foundation. Unauthorised reproduction or use is prohibited without prior written consent.

a) MoU and Agreements

Corporate partnerships are formalised through a Memorandum of Understanding (MoU) signed by authorised representatives of both parties. These Terms apply to all website interactions; specific CSR partnership terms are governed by the signed MoU.

b) CSR Eligibility

Companies contributing under Section 135 of the Companies Act, 2013 should verify our CSR-1 registration on the MCA portal (mca.gov.in) before committing funds.

c) Reporting

Impact reports and financial utilisation statements will be provided as agreed in the MoU — typically quarterly and annually.

Need of Change Foundation shall not be liable for:

• Any indirect, incidental, or consequential damages arising from use of our website
• Technical failures of third-party payment gateways (Razorpay)
• Temporary website unavailability due to maintenance or technical issues
• Changes in government policy affecting 80G tax benefits or FCRA compliance

Our maximum liability in any circumstance shall not exceed the amount of your most recent donation.

By using our website, you agree to indemnify and hold harmless Need of Change Foundation, its trustees, officers, and staff from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your violation of any applicable law
• Any content you submit through our contact forms or portal

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of our website shall be subject to the exclusive jurisdiction of the courts in Indore, Madhya Pradesh, India.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our website after changes constitutes acceptance of the revised Terms.

For significant changes, we will notify registered donors via email.
